Governo restringe visitas íntimas em penitenciárias para presos que são casados

RIO – Uma resolução publicada no Diário Oficial da União nesta quinta-feira definiu novas regras para as visitas íntimas em presídios. A decisão é do Conselho Nacional de Política Criminal e Penitenciária (CNPCP), ligado ao Ministério da Justiça. A partir de agora, apenas aqueles que estão casados ou em união estável podem obter o direito.

A publicação decreta que as “visitas conjugais”, como foram chamadas no texto, ocorram preferencialmente uma vez por mês. O visitante precisa realizar cadastro prévio no presídio e apresentar certidão de casamento ou união estável, e apenas um cadastro por preso é permitido. Para realizar a troca de cônjuge, é necessário aguardar o prazo de um ano.

O documento define a “visita conjugal” como uma “recompensa, do tipo regalia, concedida à pessoa privada de liberdade, nos termos do art. 56, II, da Lei de Execução Penal, e deve atender às preocupações de tratamento digno e de progressivo convívio familiar do recluso”.

De acordo com a nova Resolução nº 23, a visita de cônjuge ao preso em local privado deve ser concedida tanto ao preso provisório quanto ao definitivo, e o direito pode ser suspenso, por tempo determinado, de acordo com a decisão fundamentada da administração do estabelecimento penal, caso haja falta disciplinar.

Caso não existe certidão de casamento ou de união estável, há a possibilidade do documento ser substituído por uma declaração assinada pelo preso e pela pessoa indicada – que também não pode estar privada de liberdade. Neste caso, o documento deve ser encaminhado à penitenciária
